    Texas Lobbyist Guide: How Government Relations Can Shape Policy and Business

    One piece of legislation, regulation, or government action can have an impact on a business long after that news cycle has passed. Sometimes a clear voice in these conversations is necessary for companies, trade groups, nonprofits, and other organizations.

    And this is where a Texas lobbyist comes in. Lobbyists usually try to reach state officials so that they can advocate for the interests of their clients. Lobbying is regulated by the Texas Ethics Commission, which mandates that some lobbyists register and report their activities.

    In Texas What A Lobbyist Actually Does

    A lobbyist is not just somebody who meets with lawmakers to advocate for the legislative agenda.

    The position may include researching proposed legislation, tracking administrative actions, consulting on policy issues with officials, preparing talking points, and assisting clients in understanding how government decisions may impact their business or industry.

    Rather, the aim of it is not to request a certain outcome. Good advocacy typically roots itself in the underlying issue, useful iteration with useful information, and a definable position.

    The Need for a Government Relations Professional on Your Team

    Yet it is hard to find an industry that is not affected by government policy.

    Operating costs could be changed by a proposed rule. An additional law may add new requirements. A budgetary decision may influence a grant or a contract with the government.

    Unless you have an internal team keeping track of these changes, small and mid-sized businesses may be unaware. And here a lobbyist can help fill that gap.

    Some common things that would be covered are:

    • Business and economic policy
    • Healthcare
    • Energy and utilities
    • Transportation
    • Education
    • Technology
    • Construction
    • Local government issues

    It largely depends on the client’s goals and what the policy issues are.

    Knowledge of Texas Government Matters

    Texas with its own legislative process, agencies, rules, and reporting requirements. Understanding how these systems work can allow an organization to communicate better.

    During a legislative session, a lobbyist may keep track of bills being introduced and debated (e.g., watch for amendments) as well as committee activity, agency actions, etc., to know what issues may affect their client’s interests.

    Timing also matters.

    A policy issue pushed earlier is likely to get more notice than this one after the other has been determined. By keeping their clients up to date, they are able to better react before the issue turns into an emergency.

    Building the Right Message

    Nice vocal cords are not the sole province of good lobbying. Employing a manner in which decision makers can understand the information in.

    A direct message should specify what the problem is, which works on whom, and an outline of facts that support your desired position.

    A business could, for instance, be against a proposed regulation because of anticipated expense. Its rep could give data, describe the operational effect of creating this exception, and propose a reasonable alternative instead of making that sweeping statement.

    Such an approach offers policymakers a few useful nuggets.

    Relationship is Part of the Work

    Ongoing communication is usually involved within Government relations.

    A lobbyist can work with legislators, legislative staff, agency officials, industry groups, and other interests. Being a professional often also helps share information and other perspectives.

    But relationships alone will not suffice.

    A lobbyist still must know the client’s problem and convey it correctly. Credibility, losing it is a lot easier than getting it back.

    Texas Lobbying Has Reporting Rules

    Texas law has certain registration and reporting requirements that apply to lobbyists.

    According to the Texas Ethics Commission, individuals who make qualifying direct communications with members of the legislative or executive branch need to register and file periodic lobbying reports if they exceed certain compensation or expenditure thresholds.

    Information such as employers or clients, compensation, subjects, & additional required information. The Commission also keeps searchable activity and registration information.

    These requirements maximize the importance of compliance in professional lobbying.

    Selecting a Lobbyist: Questions to Ask

    It is important to recognize that vetting a person or firm means more than a list of names.

    Open from this identify what area you need help with. And then search for experience in that particular policy area!

    Ask potential lobbyists:

    What types of cases do you usually manage?

    Experience in your industry can help a lobbyist understand the real-world ramifications of proposed legislation or regulations.

    How do you keep track of policy changes?

    Government activity can move quickly. You want someone who can spot trends and what they mean.

    Who will work on the account?

    Some firms involve several professionals. Make sure you know who will be doing your work and who you will talk to.

    How do you measure progress?

    A good lobbyist can talk about what they are doing without promising a political result.

    Compliance Can Never Be an Afterthought

    There are rules about lobbying which must be taken seriously.

    As the state-wide regulatory authority for lobbyists, the Texas Ethics Commission offers registration forms, activity reports, filing instructions, and additional resources.

    Registration requirements can also change. Current guidance from the Commission states that lobbyists should be relying on current rules as thresholds for compensation and expenditure are all on a sliding scale over time and there will thus appear outdated figures.

    Accurate record-keeping and filing are essential to avoid compliance issues that could easily be avoided.

    Advocacy is Not Just One Bill

    Good government relations should not start and end with one piece of legislation.

    Organizations can begin to keep an eye on larger policy trends and stay in touch with stakeholders year-round. It gives them less time to dive into new issues and formulate some considered positions.

    Leverage a Texas lobbyist to link these efforts into a cohesive government relations plan.

    This can include research, communication, relationship building, monitoring of policy, and compliance assistance or certification.

    Finding the Right Path Forward

    There are challenges that can instantly create boom and bust opportunities from government decisions. However, they must know this first and be able to navigate the process themselves.

    A Texas lobbyist provides a method for a business, association, or nonprofit to articulate its needs and issues with state officials. The best leverage you can get is the intersection of excellent policy knowledge, clear communication skills, reliable research capacity, a strong professional network, and adherence to Texas lobbying rules.

    That’s especially true for any organization that may be a target of state legislative or administrative action since an effective government relations strategy can help to pivot quickly, act quickly, and lend credibility to critical policy discussions.
