    Long-Term Disability Benefits: Overview of What Happens After You File a Claim

    If you are unable to work due to a long-term disability, there is a multi-step process associated with applying for disability benefits. Below is information detailing what happens after someone files a claim for long-term disability benefits, and how soon they can expect to start receiving benefits.

    Filing a Disability Benefits Application

    Filing an initial claim for long-term disability benefits will set off an investigation to determine if the applicant falls within the rules of the applicable policy. Remember, the insurance agency is a for-profit company looking for any way it can find to say no to a request for benefits. Instead, after filing a claim for long-term disability benefits, be prepared for the insurance company to:

    • Review employment records
    • Request production of all medical records
    • Interview coworkers
    • Review any claims for social security disability insurance or Workers’ Compensation
    • Require the applicant to attend “independent medical examinations” by their own doctors
    • Request summaries or contact with your doctors and other medical providers

    The investigative process may feel unpleasant and invasive to the applicant. This is understandable since there are instances when insurance companies cross the line and invade an applicant’s personal privacy. However, many long-term disability insurance policies require the applicant to cooperate with such an investigation and comply with all requests for information. If an applicant wrongfully refuses to cooperate, it could cause the disability benefits claim to be denied.

    What To Do If Your Disability Benefits Application is Denied

    If you believe you were wrongfully denied long-term disability benefits, or if the insurance adjuster takes too long to make a decision, consider contacting an experienced and knowledgeable long-term disability attorney. You may have grounds to file a claim against the insurance company for wrongful denial. Except in cases of undue delay, you do have to go through your insurance policy’s appeals process first, so be sure you review the language of your policy carefully to protect your rights.
